Terms of Service

1. Agreement
By accessing or using CallIntel ("the Service"), you agree to be bound by these Terms of Service. The Service is provided by CallIntel and is intended for use by insurance agencies, brokerages, and related businesses. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these terms.
2. Service Description
CallIntel provides a real-time integration between VoIP phone systems and Agency Management Systems. Features include screen pops, automatic call logging, AI-powered call summaries, SMS logging, analytics, team management, and a support ticket system. The Service acts as a processing bridge between your existing systems and does not replace your phone system or AMS.
3. Account & Access
You are responsible for maintaining the confidentiality of your account credentials, API keys, and any VoIP or AMS credentials entered into the Service. You agree to notify us immediately of any unauthorized use of your account. You may invite team members and assign roles (Owner, Admin, Agent, Viewer) to control access within your organization. You are responsible for the actions of all users within your organization.
4. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable law or regulation
- Attempt to gain unauthorized access to the Service, other accounts, or systems connected to the Service
- Interfere with or disrupt the integrity or performance of the Service
- Use the Service to transmit malicious code, spam, or unsolicited communications
- Reverse engineer, decompile, or disassemble any portion of the Service
- Use the Service to monitor calls or communications without proper consent as required by applicable law
- Exceed reasonable API usage limits or circumvent rate limiting controls
5. Data Processing
By using the Service, you authorize CallIntel to:
- Receive call event data from your VoIP provider via webhooks
- Query your AMS to match callers to existing contacts
- Create activity notes and call logs in your AMS on your behalf
- Process and temporarily store call metadata, transcriptions, and SMS content for the purpose of syncing to your AMS
All personally identifiable information (phone numbers, contact names, transcription text, SMS content) is automatically purged after successful AMS sync or within 30 days, whichever comes first. See our Privacy Policy for full details on data handling and retention.
6. Credentials & System Access
You grant CallIntel permission to access your VoIP and AMS systems using the credentials you provide during setup. All credentials are encrypted at rest using AES-256-GCM. We access your systems only to provide the Service's functionality (call logging, contact lookup, screen pops, transcription retrieval). You may revoke access at any time by removing your credentials from Settings, which immediately disables all integration functionality.
7. Pricing & Billing
The Service is offered at a base agency fee plus per-user pricing. Current pricing is available at callintel.app/pricing. A 14-day free trial is available with no credit card required. Billing is processed through Stripe. You may cancel your subscription at any time and will retain access until the end of your current billing period. We reserve the right to change pricing with 30 days' written notice.
8. Availability & Service Levels
We strive for high availability but do not guarantee uninterrupted service. The Service depends on third-party APIs (your VoIP provider, AMS provider, and our infrastructure providers including Vercel and Neon). Scheduled maintenance will be communicated via email with at least 24 hours' notice. In the event of unplanned downtime, we will provide status updates and work to restore service as quickly as possible.
9. Limitation of Liability
To the maximum extent permitted by law, CallIntel is not liable for: (a) indirect, incidental, special, consequential, or punitive damages; (b) loss of profits, data, or business opportunities; (c) data loss, missed calls, or failed integrations caused by third-party service outages, API changes, or network failures; (d) any unauthorized access resulting from your failure to secure your account credentials. Our total aggregate liability for any claims arising from use of the Service is limited to the fees you have paid to CallIntel in the 12 months preceding the claim.
10. Indemnification
You agree to indemnify and hold harmless CallIntel, its officers, and employees from any claims, damages, or expenses (including reasonable legal fees) arising from: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any applicable law or regulation; or (d) any content or data you transmit through the Service.
11. Intellectual Property
The Service, including its design, code, features, and documentation, is owned by CallIntel and protected by intellectual property laws. Your use of the Service does not grant you any ownership rights. You retain ownership of all data you input into the Service. We claim no intellectual property rights over your call data, AMS records, or business information.
12. Termination
Either party may terminate this agreement at any time. You may cancel your subscription through the Billing page or by contacting support. We may suspend or terminate your account for violation of these Terms with written notice. Upon termination, your data (call logs, credentials, organization settings, team membership) will be permanently deleted within 30 days. You may request immediate deletion by contacting support. Termination does not affect any obligations or liabilities incurred prior to termination.
13. Governing Law & Disputes
These Terms are governed by the laws of the State of Washington, USA, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the Service shall be resolved through binding arbitration in Spokane County, Washington, in accordance with the rules of the American Arbitration Association. Each party shall bear its own costs of arbitration.
14. Changes to These Terms
We may update these Terms from time to time. We will notify active customers of material changes via email at least 30 days before they take effect. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms. If you do not agree to updated Terms, you may terminate your account before they take effect.
